1. Acceptance of Terms

Welcome to WorthySpot. By accessing or using our platform, mobile application, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

WorthySpot is a social platform where users can share photos, participate in community voting, and earn rewards. These Terms govern your use of all features, content, and functionality offered through WorthySpot.

2. Eligibility

You must be at least 13 years of age to use WorthySpot. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features, you must create an account using one of our supported authentication providers (e.g., Google, Apple, Facebook, or X). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of all photos, images, and other content ("User Content") that you upload or share through WorthySpot. By posting User Content, you grant WorthySpot a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works from your User Content in connection with operating and providing the Service.

You agree not to post User Content that:

  • Infringes on any third party's intellectual property rights
  • Contains illegal, harmful, threatening, abusive, or defamatory material
  • Contains sexually explicit or pornographic material
  • Promotes discrimination, hatred, or violence against any individual or group
  • Contains viruses, malware, or any other harmful code
  • Violates any applicable law or regulation

5. Voting and Rewards

WorthySpot allows users to vote on shared photos and earn rewards based on community engagement. Rewards are subject to the following conditions:

  • Rewards are earned through genuine engagement and are non-transferable unless otherwise specified
  • WorthySpot reserves the right to modify, suspend, or discontinue the rewards program at any time
  • Any form of manipulation, including fake accounts, automated voting, or vote trading, will result in disqualification and potential account termination
  • Reward values and redemption methods are determined solely by WorthySpot and may change without prior notice

6. Prohibited Conduct

When using WorthySpot, you agree not to:

  • Use the Service for any unlawful purpose
  • Harass, bully, or intimidate other users
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use bots, scrapers, or other automated means to access the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Create multiple accounts for the purpose of manipulating votes or rewards

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of WorthySpot and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of WorthySpot.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the app settings.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WORTHYSPOT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WORTHYSPOT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to use the Service after any revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority.
